What Law Applies to A Driver in The Rightmost Lane

The law that applies to a driver in the rightmost lane is the “Move Over Law”. The Move Over law applies to the driver in the pictures below.

Explain the options to legally drive by the emergency vehicles stopped in the right shoulder lane.

  • Slow down to a speed 20 mph below the posted speed limit.
  • Slow down to 5 mph if the speed limit is 20 mph or less.

What is Florida’s Move Over Law

Florida’s Move-Over law requires drivers to move over a lane when it’s possible to do so safely if law enforcement, emergency vehicles, utility services, sanitation, tow trucks, or construction vehicles are parked on the shoulder with hazard lights on.

If a driver is unable to move over, or if it’s only a two-lane road, the driver should slow to 20 mph below the speed limit or 5 mph if on a road where the speed limit is below 20 mph.

Why Florida has a Move Over Law

Drivers in the rightmost lane should move over when there are cars stopped in the right shoulder for safety reasons. Changing lanes reduces the risk of crashing into the vehicles or pedestrians on the side of the road.
